Court Restrains Police from Arresting APC Executives Who Suspended National Chairman, Ganduje

The Kano High Court has issued an ex parte order restraining law enforcement authorities from taking action against All Progressives Congress (APC) ward officers in Ganduje Ward, Dawakin-Tofa local government area of Kano State. This order prohibits the Inspector General of Police, Assistant Inspector General, and Commissioner of Police in Kano from inviting, arresting, or harassing these executives.

This decision comes in the wake of the suspension of Abdullahi Ganduje, the National Chairman of the APC, by the executives, which had triggered controversy. Despite the state working committee of the party overturning the suspension, the ward officers sought legal protection to affirm their decision.

Daily Trust reported that security agencies had initiated a manhunt to apprehend the ward officers following the suspension of Ganduje.

In response to the ward officers’ plea for protection, Justice Yusuf Ubale Muhammad issued a consolidated order on May 2nd, 2024. This order restrains the APC National Working Committee, the State council of the party, and Abdullahi Ganduje from utilizing security forces to arrest or detain the ward executives until the motion on notice is heard and determined.

The motion, filed by factional ward officers represented by their counsel Shamsu Ubale Jibrin Esq, seeks to safeguard their fundamental human rights as enshrined in the constitution. The court adjourned the case to June 5th, 2024, for the hearing of the motion on notice.
