Woman Files for Divorce, Cites Husband’s Body Odor, Poor Hygiene Habits 

A Turkish woman, identified as A.Y., has filed for divorce from her husband, C.Y., primarily attributing the dissolution to his alleged inadequate personal hygiene practices. The case, brought before the 19th Family Court in Ankara, shed light on the husband’s infrequent bathing, persistent body odor, and minimal dental care routine.

A.Y.’s lawyer, Senem Yılmazel, presented a compelling case, revealing that the defendant often wore the same clothes for extended periods, rarely showered, and emitted a constant odor of sweat. To substantiate these claims, witnesses, including mutual acquaintances and co-workers of the husband, provided statements attesting to his poor personal hygiene.

The court not only granted the divorce but also ruled in favor of the woman, ordering C.Y. to compensate his ex-wife with 500,000 Turkish lira ($16,500). Yılmazel emphasized the importance of shared responsibilities in married life, stating, “If the shared life becomes unbearable due to behavior, the other party has the right to file for divorce. We must all be careful in human relations!”

Turkish civil law classifies divorce reasons into special and general categories, with the latter encompassing factors that make life intolerable for one or both parties. In this instance, the husband’s hygiene habits fell under the purview of general reasons, leading to the Regional Court of Justice and the Supreme Court of Appeals’ final approval of the divorce.

Court documents disclosed that C.Y. reportedly showered at most once every 7-10 days and brushed his teeth only once or twice a week, resulting in what witnesses described as an “unbearable” breath. Notably, some of the husband’s co-workers voluntarily testified, stating that his offensive body odor made working alongside him a challenging ordeal.

This case underscores the significance of personal hygiene in marital relationships and highlights how it can be a legitimate factor in legal proceedings, signaling a precedent in Turkish family law.
