Legal Twist: Charges Against Emefiele Dismissed by Court

In a surprising turn of events, the Lagos Division of the Federal High Court has struck down charges of illegal arms possession against Godwin Emefiele, the suspended governor of the Central Bank of Nigeria. The decision, delivered by Justice Nicholas Oweibo, came after an application by the federal government to withdraw the charges due to emerging facts requiring further investigation.

The charges, which accused Mr. Emefiele of illegal possession of firearms and ammunition, were dismissed for lack of diligent prosecution. Mohammed Abubakar, the director of public prosecutions (DPP) at the federal ministry of justice, made an oral application for the withdrawal on Tuesday, citing the need for additional investigation. This application was met with opposition from Mr. Emefiele’s counsel, Joseph Daudu, who argued that the government had violated the court’s order by failing to remand Mr. Emefiele at the Nigeria Correctional Service.

Joseph Daudu further contended that the application for the withdrawal of charges should have been presented in writing. However, Justice Nicholas Oweibo ruled that section 108 of the Administration of Criminal Justice Act empowered the DPP to withdraw the charges, even without a written application. The judge also expressed his concerns about the prosecution’s lack of adherence to court orders and their apparent disregard for the judicial process.

Justice Oweibo stated, “The prosecution has shown signs that they are not law-abiding and have no respect for the court. Of what benefit will it be to keep the file in the court’s docket? I believe the proper thing is to allow them to withdraw the charge.”

Ultimately, the court granted the application for withdrawal, effectively dismissing the charges against Godwin Emefiele. This decision comes after Mr. Emefiele had been granted bail on July 25, with a bond set at N20 million..
