JUST IN: National Industrial Court Restrains NLC, TUC from Nationwide Strike

The National Industrial Court recently issued a restraining order barring the Nigeria Labour Congress (NLC), Trade Union Congress (TUC), and their affiliates from commencing a nationwide strike slated to begin on November 14. This directive, authorized by President of the Court, Justice Benedict Bakwaph Kanyip, was a response to an ex-parte application presented by the Federal Government and the Attorney General of the Federation, arguing against the planned strike.

Justice Kanyip invoked specific sections of the National Industrial Court Act to justify the order, highlighting the potential hardships that such a strike might cause to law-abiding citizens and businesses. Tijani Gazali, a Senior Advocate of Nigeria representing the Federal Government, emphasized the adverse impact of recent protests, especially blockades at major airports, and warned of possible disturbances to the peace if the strike proceeded.

Acknowledging the government’s concerns, Justice Kanyip granted the requested restraining order, mandating its display at the defendants’ last known address and publication in two national dailies. Furthermore, the case has been transferred to Justice Olufunke Anuwe, who specializes in similar labour-related disputes.

This judicial intervention aims to maintain peace and tranquility while addressing the potential fallout of the planned strike, emphasizing the court’s authority to ensure stability amidst labor disputes.
