JUST IN: Appeal Court Upholds Ruling Nullifying Rivers 2024 Budget
The Court of Appeal in Abuja has upheld a January 22 ruling by Justice James Omotosho of the Federal High Court, which nullified the passage of Rivers State’s N800 billion budget for 2024 by a faction of the House of Assembly.
In a decision delivered on Thursday, a three-member panel led by Justice Joseph Oyewole determined that the appeal filed by Rivers State Governor Siminalayi Fubara lacked merit. Justice Oyewole emphasized that the governor had previously withdrawn all documents related to the case at the trial court, effectively conceding to the plaintiffs’ allegations and the facts presented.
Justice Omotosho’s earlier ruling characterized the budget’s approval by the five lawmakers, including Ehie Edison, as an “aberration and illegality.” He ordered Governor Fubara to resubmit the budget to the Martins Amaewhule-led Assembly for proper consideration.
