U.S. to Fast-Track Visas for Graduates with Job Offers
The Biden administration has unveiled new measures to accelerate the issuance of employment-based nonimmigrant visas for recent US college graduates with job offers. This initiative aims to bolster the US economy by retaining skilled workers and simplifying immigration procedures.
Set to take effect by July 18, the US Department of State will release new guidelines for consular officers to recommend the Department of Homeland Security (DHS) approve waivers of ineligibility. These waivers are critical for expediting the visa process while maintaining thorough screening and security protocols.
Last month, amid the election season, the administration outlined its strategy to expedite visas for international students graduating from US colleges. This move targets those with job offers, aiming to swiftly grant visas to eligible candidates.
Employment-Based Nonimmigrant Visas
Employment-based nonimmigrant visas permit foreign nationals to work in the US temporarily. Employers typically initiate the visa process by filing a petition, with the H-1B visa being the most common among other temporary worker visas.
Applicants denied visas are informed of the reasons by consular officers. Some may qualify for a waiver, offering another chance to secure their visa. The DHS and US Customs and Border Protection’s Admissibility Review Office manage these waiver requests.
Employers must first obtain approval for a Petition for a Nonimmigrant Worker (Form I-129) from US Citizenship and Immigration Services (USCIS). Once approved, they receive a Notice of Action (Form I-797), enabling the prospective employee to apply for their visa by completing the Online Nonimmigrant Visa Application (Form DS-160) and scheduling an interview at a US embassy or consulate.
In the fiscal year 2023, USCIS and the Department of State issued over 192,000 employment-based immigrant visas, ensuring no visas went unused for the second consecutive year. However, the new measures’ impact on nonimmigrant visa issuance during the election year remains uncertain.
The Biden-Harris administration’s latest announcement signifies a major step towards attracting and retaining skilled graduates. By streamlining visa processes and providing clear waiver guidelines, the administration aims to enhance the US workforce and maintain its competitive edge.
