President Should Not Appoint INEC Chairman – Former INEC Boss Jega

In a significant address at a two-day retreat organized by the National Institute for Legislative and Democratic Studies (NILDS) in Ikot Ekpene, Akwa Ibom State, former Chairman of the Independent National Electoral Commission (INEC), Prof Attahiru Jega, urged for crucial amendments to the Electoral Act, 2022. Jega emphasized that while the current electoral law is a historic improvement for Nigeria, it still holds room for enhancements to eliminate ambiguities and bolster its provisions.

One of the key amendments proposed by Jega is to make the electronic transmission of election results mandatory for the 2027 general elections. He stated that ensuring transparency and accuracy in the transmission of results is essential for the integrity of the electoral process.

Additionally, Jega called for a significant change in the process of appointing the INEC Chairman and National Commissioners. He advocated for the President to be divested of the power to appoint these officials, aiming to remove any perceptions of partisanship in the commission. Instead, he recommended entrusting the responsibility of their appointment to a more neutral entity, suggesting a joint committee of the National Assembly for this task.

Jega also addressed concerns related to the process of transmission of election results, emphasizing the need for clarity and transparency. He recommended that the Act should mandate the electronic transmission of results, including the uploading of polling unit-level results and result sheets used at various stages of result collation.

Moreover, Jega highlighted the importance of early voting for eligible voters on election duty, including INEC staff, observers, security personnel, and journalists. He proposed allowing citizens on essential service abroad to vote in presidential elections, emphasizing the need to enhance the inclusion of women in elective positions and political party candidate lists.

Other amendments proposed by Jega include proscribing cross-carpeting by elected officials, not only at the National Assembly level but also for governors and local government chairmen. He also recommended stringent conditions for candidate withdrawal and replacement to prevent abuse, empowering INEC to screen and, if necessary, disqualify candidates with questionable credentials.

In conclusion, Jega underlined the significance of ensuring that all election-related cases are resolved and judgments made before the date of swearing-in, particularly for elected executive positions. His proposals aim to strengthen the electoral process, enhance transparency, and uphold the principles of non-partisanship in the conduct of elections in Nigeria.
