Justice Omotosho Explains Why Nnamdi Kanu Received Life Sentence Instead of Death Penalty

 

Justice James Omotosho of the Federal High Court in Abuja has given insight into his decision to sentence Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), to life imprisonment rather than impose the death penalty following his terrorism conviction on Thursday.

 

During the judgment, the court noted that the offences for which Kanu was convicted ordinarily attract the death penalty. However, Justice Omotosho said he chose leniency, citing the moral and religious imperative to show mercy. He referenced teachings from the book of Matthew, emphasizing that mercy remains a core value encouraged by faith traditions across the world.

 

The judge also observed that many countries are gradually moving away from capital punishment, reinforcing the global shift toward more humane sentencing options.

 

Justice Omotosho ruled that Kanu’s incarceration must be carried out in a facility appropriate for his status, stating that Kuje Correctional Centre would not fulfill the purpose of the sentence. Instead, he directed that Kanu be held in protective custody at any secure location designated by authorities.

 

The court further ordered that Kanu must not access electronic devices except under strict supervision by the Office of the National Security Adviser. In addition, the transmitter used for his broadcasts was forfeited to the Federal Government. Other related equipment will also be confiscated if no appeal is filed.
