JUST IN: Supreme Court Overturns National Lottery Act, Cedes Power to States
The Supreme Court of Nigeria has declared the National Lottery Act of 2005 unconstitutional, ruling that the National Assembly does not have the authority to legislate on matters related to lottery and games of chance. In a unanimous decision delivered on Friday, the seven-member panel stated that such powers are solely within the jurisdiction of state Houses of Assembly.
The ruling, which was based on a suit filed in 2008 by Lagos State and several other states, clarified that the National Assembly’s legislative authority over lotteries and games of chance is limited to the Federal Capital Territory (FCT) only. Justice Mohammed Idris, who delivered the lead judgment, ordered that the National Lottery Act 2005 be rendered void and no longer enforced in the states.
