JUST IN: Constitutional Challenge Filed Over Nigeria’s New Tax Regime
A suit has been filed at the Federal High Court, Abuja, questioning the legal foundation of Nigeria’s newly implemented tax regime.
On February 6, 2026, Emmanuel Orjih and the Incorporated Trustees of Lawyers for Civil Liberty (LACLIV) initiated proceedings against the President of the Federal Republic of Nigeria, the Clerk of the National Assembly, the Attorney General of the Federation, and the National Assembly of Nigeria.
The action, brought by originating summons, asks the court to examine a key constitutional issue: whether the version of the tax bill passed by the National Assembly is the same document that received presidential assent, was subsequently gazetted, and is now being enforced across the country.
According to the claimants, there is a discrepancy between the harmonised bill approved by lawmakers and the document that became law. Despite this alleged inconsistency, the tax regime is already operational, with collections underway.
