How Court of Appeal Ruling Ousted Several National Assembly Members from Seats in 2023 Election Litigation Battles
In a series of unprecedented judicial verdicts, the Court of Appeal has delivered a blow to several members of the National Assembly, resulting in their ousting after prolonged election litigation battles. This turn of events has significantly impacted both the Senate and the House of Representatives, leading to a major shakeup after a five-month legal tussle.
The appellate court’s decisions have resulted in the removal of multiple lawmakers, primarily on grounds of electoral irregularities and pre-election complications. The Senate witnessed the expulsion of five legislators, affecting various political parties. The House of Representatives, on the other hand, experienced the dismissal of no less than twelve lawmakers.
Among the ousted members, there were notable figures, including Elisha Abbo of Adamawa APC, known for previous controversies. The Court of Appeal in Abuja ruled in favor of Amos Yohanna, citing electoral irregularities and manipulation of results.
Similarly, figures like Darlington Nwokocha of Abia LP, Abubakar Ohere of Kogi APC, Napoleon Bali, and Simon Mwadkwon of Plateau PDP, were among those affected by the series of dismissals, primarily influenced by party crises and pre-election matters.
The House of Representatives also experienced a significant turnover, with members like Simon Bagos, Beni Lar, Isaac Kwalu, and Peter Gyendeng of Plateau PDP losing their seats due to party structural issues.
The Court’s decisions reverberated across various states, affecting members from Enugu, Abia, Kaduna, Kano, Imo, and Adamawa, with allegations ranging from certificate forgery to electoral irregularities.
This wave of judicial action has not only altered the political landscape but has also emphasized the critical scrutiny of pre-election matters and party structures, resulting in significant repercussions for numerous lawmakers across both houses.
The aftermath of these rulings will prompt by-elections within 90 days for some areas, leaving uncertainties about the participation of previously ousted members. The Court’s decisions have sent shockwaves through the political arena, raising questions about the stability and adherence to electoral processes.
The implications of these judgments are set to reshape the composition of the National Assembly, presenting both challenges and opportunities for various political entities as they prepare for potential by-elections and subsequent reconfiguration.
