Federal High Court Bars Governor Fubara from Hindering Rivers State Assembly Functions

The Federal High Court in Abuja has issued a restraining order against Governor Siminalayi Fubara and others, preventing them from obstructing the functions and financial operations of the Rivers State House of Assembly. The court emphasized the constitutional importance of preserving the State House of Assembly as a fundamental institution.

Justice J.K Omotosho, presiding over the case (Suit No. FHC/ABJ/CS/1613/2023), highlighted the substantial presence of 25 out of 31 members of the State House of Assembly actively conducting business. The court acknowledged the urgency of preserving the constitutional integrity of the legislative body.

The legal action, initiated by Chief Ferdinand Orbih (SAN) and M.A. Ebute (SAN) on behalf of the Rivers State House of Assembly and its Speaker, Rt. Hon. Martine Chike Amaewhule, targeted not only Governor Fubara but also the State Attorney General, Commissioner of Finance, Accountant General, Rivers State Civil Service Commission, Inspector General of Police, and various federal legislative figures.

The court’s interim injunction includes directives restraining the defendants from assuming the functions of the Rivers State House of Assembly, withholding its funds, and interfering with the appointment or removal of key personnel, including the Clerk and Deputy Clerk.

These legal measures are in effect until the court hears and determines the motion on notice for interlocutory injunction filed on November 29, 2023.
