Federal Government Begins Prosecution of INEC Officials, Others for Electoral Fraud
The Federal Government, in collaboration with the Nigerian Bar Association (NBA), has initiated legal proceedings against several individuals, including staff members of the Independent National Electoral Commission (INEC) and political party members. These individuals stand accused of various electoral offenses during the 2023 general elections.
The aftermath of the February 25, 2023, presidential and National Assembly elections saw over 700 individuals arrested by the Nigeria Police Force for violating electoral laws, as reported by the immediate past Inspector-General of Police, Usman Baba.
INEC, on May 2, 2023, announced its commitment to prosecute 215 out of the 774 persons handed over to it by the NPF for various electoral offenses. To ensure effective prosecution, INEC partnered with the NBA, which offered pro bono legal services.
Out of the 215 cases received by the commission, 196 involve electoral offenses, such as vote-buying, arms possession, and other infractions committed during the 2023 polls. The National Publicity Secretary of the NBA, Habeeb Lawal, confirmed that the prosecution is underway in magistrates’ and high courts across states and the Federal Capital Territory.
Lawal emphasized that the offenses span dereliction of duty, criminal conspiracy, disorderly conduct at election venues, unlawful possession of arms on election day, snatching and destroying of INEC materials, electoral malpractices, unlawful possession of election materials, voter inducement, vote-buying, malicious damage and assault, and electoral violence. The suspects include both INEC officials and political party members.
The NBA, through its members handling the cases pro bono, aims to send a strong deterrent message to individuals desperate for political offices. Habeeb Lawal expressed hope that successful prosecutions would positively impact and sanitize Nigeria’s electoral system and culture.
Chief Press Secretary to the INEC Chairman, Rotimi Oyekanmi, affirmed the commission’s commitment to holding individuals accountable for their actions. Oyekanmi stated that the collaboration with the NBA reinforces INEC’s resolve not to condone electoral misconduct, sending a stern warning to potential offenders.
The ongoing prosecution across magistrates’ courts and high courts nationwide aligns with the jurisdiction granted by the Electoral Act, marking a significant step toward ensuring the credibility and fairness of future elections in the country.
