Court Orders Release of Babcock University Student Detained by EFCC Over Mother’s Debt

A landmark decision was reached yesterday at the Federal High Court in Ikoyi, Lagos, as Miss Oluwateniola Omidiji, a student at Babcock University, secured her release from the custody of the Economic and Financial Crimes Commission (EFCC). The court’s ruling came in response to a fundamental rights action suit filed by Miss Omidiji, who had been detained by EFCC operatives due to a debt allegedly owed by her mother, Mrs. Omoniyi Omidiji.

The case stems from an investment made by Mr. Charles Nwoko, who claimed to have invested N100 million in Mrs. Omidiji’s business in 2020. Alleging non-payment of the debt and interest, Nwoko pursued Oluwateniola for the sum, given her mother’s absence from Nigeria. Despite being a mere 19 years old, Oluwateniola had spent 11 days in EFCC detention before the court intervened.

In a decisive move, Justice Y. Bogoro granted the reliefs sought in Oluwateniola’s application, emphasizing the importance of upholding fundamental human rights. The court’s decision signals a departure from the practice of holding individuals accountable for debts incurred by their relatives.

The case highlights broader concerns about the legal implications of familial debts and underscores the need for clarity in such matters. Oluwateniola’s ordeal serves as a reminder of the complexities inherent in financial disputes and the importance of safeguarding individual rights in legal proceedings.

The outcome of this case sets a precedent for future disputes involving familial debts and underscores the judiciary’s commitment to upholding the rule of law and protecting citizens’ rights. As the legal battle continues, it remains to be seen how this decision will influence similar cases in the future.

For Oluwateniola Omidiji, this ruling represents a significant victory in her quest for justice and underscores the importance of legal recourse in defending individual rights against unjust detention.

No date has been set for the hearing of the case, but further proceedings are scheduled for May 21, 2024.
