Appeal Court Dismisses Ajimobi’s Appeal

Former governor of Oyo state, Abiola Ajimobi’s quest to represent Oyo South Senatorial District in the the Senate yet again suffered another blow as the Court of Appeal sitting in Ibadan struck out his appeal challenging the victory of Senator Kola Balogun of the Peoples Democratic Party (PDP).

In the judgement delivered by the head of the three-man panel, Justice Haruna Tsammani dismissed Ajimobi’s appeal on the grounds that it lacks merit adding that the Tribunal that earlier upheld Balogun’s victory was right its judgement.

The court also struck out Ajimobi’s petition challenging the eligibility of the PDP’s candidate to participate in the election. Ajimobi had told the court that Balogun was not qualified to stand for the election because he did not participate in the primary election held in 2018. The court said the issued was a pre-election matter and should have been taken to the federal High Court.

The Independent National Electoral Commission (INEC) had declared Balogun winner of the February 23, 2019 National Assembly after He polled 105,720 votes to beat Ajimobi who scored 92,217 votes.
