Activist to Serve Court Processes at Ngige, Obi, and Obiano’s Homes
A Federal High Court in Awka, Anambra State, has granted activist Ifeanyichukwu Okonkwo permission to serve court processes at the residences of three former Anambra State governors. This move targets Chris Nwabueze Ngige, Peter Obi, and Willie Obiano, as part of a suit challenging the state’s prolonged undemocratic local government administration.
Justice Hauwa J. Yilwa issued the order on Tuesday, following an ex-parte motion filed by Okonkwo, a former governorship aspirant. The court’s decision allows for substituted service, which includes pasting court documents at the last known addresses of the defendants and requires photographic evidence of the service to be attached to the Affidavit of Service.
The suit, marked FHC/AWK/CS/90/2024, lists the three former governors, Ngige (2003-2006), Obi (2006-2014), and Obiano (2014-2022), along with Livinus Onyenwe and members of the state’s House of Assembly. Okonkwo’s legal action focuses on addressing the issues related to the administration under their tenures and the current governance by Professor Charles Chukwuma Soludo.
The court’s order specifies:
- Service of court processes by pasting at the defendants’ last known addresses.
- Photographic proof of the bailiff’s action to be included in the Affidavit of Service.
- Adoption of this mode for serving all related court processes.
Additionally, the court ruled that the Clerk of the Anambra State House of Assembly will receive processes on behalf of the 4th defendant and directed service to a last known address within the state for Ngige.
The court has scheduled the hearing for the substantive suit on Wednesday, July 17, 2024.
