Lawyer who Assaulted Wife Faces Potential Prosecution Despite Victim’s Withdrawal
Ekere Ebong, the lawyer caught on camera assaulting his wife, Ekemini, may still face prosecution despite her decision to withdraw from the case, according to legal experts. The incident, which occurred on December 14, 2023, sparked nationwide outrage after a viral video captured the assault in front of their Uyo residence.
The Akwa Ibom State Government is considering pressing charges against Mr. Ebong, as some lawyers argue that the crime committed is against the state, making the victim’s opinion secondary in the prosecution process. Police spokesperson Odiko Macdon revealed that Mr. Ebong, a known habitual perpetrator of violence, had dehumanized his wife, causing severe injuries.
Although Mr. Ebong was arraigned and granted bail, the Nigerian Bar Association (NBA) Uyo Branch has set up a disciplinary committee to address the senior lawyer’s actions, accumulating over 17 years of practice.
Despite the assaulted wife’s letter dated December 20, 2023, expressing her desire to withdraw from the case, legal experts, including James Ibor, argue that she is a compellable witness, and her withdrawal may not prevent prosecution. Mr. Ibor emphasized the NBA’s commitment to ensuring justice for all parties involved.
While the assaulted wife’s withdrawal may be influenced by societal pressures, legal analysts stress that the evidence, including the confessional statement made by Mr. Ebong and the viral video, could be sufficient for conviction, even without her testimony.
The incident has triggered widespread condemnation, with Akwa Ibom State Governor Umo Eno pledging support for justice and the Minister of Women Affairs, Uju Kenedy-Ohanenye, vowing to pursue prosecution, regardless of the victim’s stance.
As the legal proceedings unfold, the case continues to draw attention, highlighting the broader societal conversation surrounding domestic violence and the pursuit of justice.
