JUST IN: Supreme Court Dismisses Tonye Cole’s Appeal Against Fubara’s Election
The Supreme Court has dismissed the appeal lodged by Tonye Cole and the All Progressives Congress (APC) against the election outcome that secured Siminalayi Fubara as the Governor of Rivers State. The court ruled that the appellant failed to substantiate allegations of non-compliance with the Electoral Act and other claims.
Tonye Cole, who represented the APC in the March 18, 2023 election, contested Governor Fubara’s victory, asserting that Fubara hadn’t resigned as the accountant general of Rivers State before the election. Additionally, Cole raised concerns about alleged irregularities, non-compliance with the Electoral Act, and corrupt practices.
However, the Supreme Court deemed the appeal incompetent and subsequently dismissed it. This decision upholds the prior judgments of the Court of Appeal and the Tribunal, affirming Fubara’s win as the Rivers State Governor under the Peoples Democratic Party (PDP).
