A federal judge in the United States has dismissed the case against former President Donald Trump concerning classified documents. Judge Aileen Cannon of the United States District Court for the Southern District of Florida, West Palm Beach Division, ruled that the prosecutor assigned by the Biden administration was not legally appointed.
Mr. Trump, who is currently in the spotlight as he accepts the Republican Party’s presidential nomination for the third time, successfully argued that special counsel Jack Smith was unlawfully appointed when he initiated the charges. The decision, handed down Monday morning, overturned charges filed against Trump in June 2023.
Judge Cannon emphasized that Smith, not being a sworn attorney of the United States, violated constitutional guidelines under the appointments clause. Furthermore, she stated that Smith’s appointment also breached appropriations statutes due to the indefinite allocation of funds for his activities.
This legal victory adds to Trump’s momentum as he prepares to accept the Republican nomination in Milwaukee, Wisconsin later this week.
