ICYMI: Again‚ Court Stops Police from Enforcing Tinted Glass Permit Policy

 

The High Court of Justice of Delta State sitting in Orerokpe has issued an interim injunction restraining the Inspector-General of Police and the Nigeria Police Force from implementing or enforcing the tinted glass permit policy scheduled to take effect on January 2, 2026.

 

Justice Joe Egwu made the order following a motion ex parte filed by Mr. Israel Joe and argued by a legal team led by Kunle Edun, SAN. The suit is marked HOR/FHR/M/31/2025.

 

In granting the application, the court restrained the police and their officers, agents or representatives from implementing or further enforcing the tinted glass permit policy pending the hearing and determination of the substantive application. The court also barred the police from stopping, harassing, arresting, detaining or extorting the applicant and other citizens or motorists under the guise of enforcing the policy.

 

Justice Egwu held that the respondents must not interfere with the constitutional rights of Nigerians, including the rights to dignity, privacy, freedom of movement and ownership of property, while the matter remains before the court.

 

The court further ordered substituted service of all court processes on the Inspector-General of Police and the Nigeria Police Force through the Commissioner of Police, Delta State Command, at the command headquarters in Asaba. The judge ruled that such service would be deemed proper and sufficient.

 

After listening to submissions from counsel, the court granted the motion ex parte dated and filed December 17, 2025, as prayed, and fixed December 24, 2025, for the hearing of the motion on notice.

 

Meanwhile, the police have responded to concerns raised by the Nigerian Bar Association over the planned enforcement. In a statement, the police said the administrative communication issued on December 15, 2025, was meant to guide internal planning and improve public understanding, stressing that it did not authorise immediate enforcement or any action inconsistent with existing court orders.
