Four Men Acquitted of Child Defilement Charges After 8 Years Behind Bars

The Ikeja Sexual Offences and Domestic Violence Court has acquitted and discharged four men who had been held on child defilement charges for over eight years. The decision, delivered by Justice Rahman Oshodi on Tuesday, cited the prosecution’s failure to substantiate the charges against the defendants.

The men, identified as Ojo Taye, John Mahason, Peter Arabo, and Adenekan Adedeji, were arrested by the Nigeria Security and Civil Defence Corps in Lagos on November 9, 2015, and had consistently maintained their innocence since their arraignment.

The three-count charge, which included allegations of defilement and sexual assault by penetration, crumbled as the Judge highlighted the prosecution’s inability to present the alleged survivors, aged five years and three years, to testify in court. This absence, according to Justice Oshodi, left the case with insufficient evidence.

During the ruling, the Judge emphasized the importance of credible testimony, stating, “The absence of the survivors in court to give their testimony has proven insufficient evidence against the defendants. It is better for nine guilty people to be set free than to convict one innocent person.”

The decision marks a pivotal moment in the legal battle, underscoring the court’s commitment to ensuring a fair and just legal process. The release of these four men after years of incarceration highlights the delicate balance between justice for survivors and protecting the rights of the accused.
